Park Use & Safety Disclaimer

Welcome to McCutchanville Greenway Park & Nature Preserve. We are pleased to offer our community a place to explore, learn, exercise, and enjoy nature. While we strive to provide a safe and enjoyable experience, visitors should understand that outdoor recreation involves inherent risks that cannot be eliminated.

By entering or using McCutchanville Greenway Park & Nature Preserve (“Greenway”), you acknowledge and accept the following terms and conditions.

Enter at Your Own Risk

Entry into and use of McCutchanville Greenway Park & Nature Preserve is entirely at your own risk.

Visitors voluntarily assume all risks associated with walking, hiking, wildlife observation, photography, volunteering, attending events, and participating in any recreational or educational activities on Greenway property.

McCutchanville Greenway Park & Nature Preserve, its Board of Directors, officers, volunteers, sponsors, donors, employees, contractors, and partners are not responsible for injuries, accidents, illnesses, property damage, or loss resulting from the use of the park or its facilities, except as otherwise required by applicable law.

Natural Environment

The Greenway is a preserved natural area. Conditions may change at any time without notice due to weather, wildlife, conservation efforts, maintenance activities, or natural events.

Visitors should expect and use caution around natural hazards, including but not limited to:

Uneven walking surfaces
Tree roots
Rocks
Gravel
Steep slopes
Bridges and boardwalks
Mud
Standing water
Wet leaves
Snow and ice
Fallen branches
Flooded trails
Tall grasses
Low-hanging limbs
Construction or maintenance areas
Limited lighting during dawn or dusk

Visitors are responsible for choosing routes appropriate for their abilities and current trail conditions.

Weather Conditions

Weather can change rapidly.

Visitors should monitor forecasts and avoid the park during:

Severe thunderstorms
High winds
Tornado warnings
Flooding
Extreme heat
Ice storms
Hazardous winter conditions

Trails may remain slippery or hazardous even after weather has improved.

Wildlife and Plants

The Greenway is home to a variety of native wildlife and plants.

Visitors may encounter:

Deer
Birds
Turtles
Snakes
Raccoons
Squirrels
Coyotes
Insects
Bees and wasps
Ticks
Mosquitoes
Poison ivy and other native vegetation

Wild animals should never be approached, handled, chased, or fed.

Please respect wildlife by observing from a safe distance.

Visitors are responsible for protecting themselves against insect bites, allergic reactions, and exposure to poisonous plants.

Water Features

The Greenway contains ponds, drainage areas, streams, wetlands, and other natural water features.

There are no lifeguards on duty.

Swimming, wading, skating on ice, or entering the water is prohibited unless specifically authorized for an organized Greenway program.

Water edges may be slippery and unstable.

Parents and guardians should closely supervise children around all water features.

Children

Children are welcome and encouraged to enjoy the Greenway.

However, children must be supervised by a responsible adult at all times.

Parents and guardians assume full responsibility for the safety and conduct of minors in their care.

Pets

Well-behaved pets are welcome unless otherwise posted.

To help protect visitors, wildlife, and the preserve:

Pets must remain on a leash at all times.
Owners must maintain control of their pets.
Pet waste must be picked up and properly disposed of.
Aggressive animals are not permitted.
Pets should not disturb wildlife or vegetation.

Failure to follow these rules may result in removal from the property.

Respect Nature

Help preserve the Greenway for future generations by practicing responsible outdoor recreation.

Visitors are expected to:

Stay on designated trails whenever possible.
Leave plants, flowers, trees, and wildlife undisturbed.
Pack out all trash.
Leave natural features where they are found.
Respect restoration areas.
Follow posted signs and barriers.
Yield respectfully to other visitors.

Prohibited Activities

Unless specifically authorized by McCutchanville Greenway, the following activities are prohibited:

Littering
Vandalism
Removal of plants, wildlife, rocks, or natural materials
Feeding wildlife
Hunting or trapping
Firearms or weapons, except as permitted by law
Fires or fireworks
Camping
Overnight parking
Alcohol or illegal drug use
Unauthorized motorized vehicles
Damaging trails or park improvements
Commercial activity without written permission
Unauthorized drones where prohibited by law or park policy

Visitors who violate park rules may be asked to leave the property and may be subject to applicable legal action.

Bicycles and Recreational Equipment

Visitors using bicycles or other permitted recreational equipment should:

Operate at safe speeds.
Yield to pedestrians.
Exercise caution around children and wildlife.
Follow posted trail rules.
Wear appropriate safety equipment.

Certain trails or areas may restrict specific recreational uses.

Organized Events

Participation in organized Greenway events, volunteer activities, educational programs, or fundraisers may require additional waivers or participation agreements.

Participants are expected to follow instructions provided by Greenway staff or volunteers during organized activities.

Personal Property

Visitors are responsible for their own personal belongings.

McCutchanville Greenway is not responsible for lost, stolen, or damaged personal property.

Emergency Situations

In an emergency, call 911 immediately.

If safe to do so, notify a Greenway representative or volunteer of the situation.

Visitors should be aware that emergency response times may vary due to the natural setting of the preserve.

Park Hours

Unless otherwise posted, visitors should use the Greenway only during designated operating hours.

Areas of the preserve may be temporarily closed due to:

Weather
Flooding
Maintenance
Conservation projects
Public safety concerns
Special events

Please obey all posted closures.

Assumption of Risk and Release

By entering McCutchanville Greenway Park & Nature Preserve, you voluntarily assume all risks associated with outdoor recreation and acknowledge that natural hazards exist throughout the property.

To the fullest extent permitted by law, you agree that McCutchanville Greenway Park & Nature Preserve, its Board of Directors, officers, employees, volunteers, sponsors, donors, contractors, and affiliated organizations shall not be liable for any injury, illness, death, property damage, or other loss arising from your use of the property, participation in activities, or presence on Greenway grounds, except where liability cannot be waived under applicable law.

Changes to This Disclaimer

McCutchanville Greenway reserves the right to update this Trail Use & Safety Disclaimer at any time.

The current version will always be available on our website.
